Privacy Policy

1. Basic provisions

1.1. This privacy policy (the "Policy") summarises the Lessor's practices and processes for protecting personal data in connection with operating the Obytňák Vysočina website (the "Website") and providing services to customers (motorhome rental).

1.2. The processing of personal data is governed by Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll., on the Processing of Personal Data.

2. Scope and purposes of processing

2.1. The Lessor processes personal data for the purposes set out in paragraphs 2.2 and 2.3 of this Policy.

2.2. For the purpose of handling a booking request and concluding and performing the rental agreement (incl. payment handling – deposit and final invoices, refundable deposit), the Lessor processes the customer's personal data to the following extent:

• first and last name
• home address
• ID card and driving licence number (or passport number)
• company ID and VAT ID, where the customer is a business
• e-mail address
• phone number
• bank account number (for refunding the deposit or any overpayment)

2.3. Where the customer has given consent, the Lessor processes the following personal data for the purpose of sending commercial offers and communications (within the meaning of Section 7 of Act No. 480/2004 Coll., on Certain Information Society Services): first and last name, e-mail address and phone number.

3. Conditions of processing

3.1. The Lessor processes the customer's personal data only for as long as necessary for the purposes above, but no longer than 10 years from the end of the relevant agreement (due to statutory retention periods for accounting and tax records), both electronically in an automated manner and on paper (the signed agreement, identity documents presented at vehicle hand-over).

4. Obligation to provide data

4.1. Providing personal data by the customer is a contractual requirement:

• failure to provide the data under paragraph 2.2 (for performing the contractual relationship) makes it impossible to conclude the rental agreement under the Lessor's Terms & Conditions;
• failure to give consent under paragraph 2.3 (for sending commercial offers) has no effect on concluding the agreement – the customer will be treated the same as if consent had been given.

5. Customer rights regarding the processing of personal data

5.1. Right to withdraw consent to processing

The customer has the right to withdraw, at any time, any consent given for sending commercial offers and communications, by sending a request to obytnakvysocina@icloud.com.

5.2. Right to withdraw consent to commercial communications

Regardless of paragraph 5.1, the customer may withdraw consent to receiving commercial communications at any time, by sending a request to the e-mail address above.

5.3. Right of access to personal data

The customer has the right to obtain confirmation from the Lessor as to whether their personal data is being processed and, if so, to access that data and the following information:

• the purposes of processing;
• the categories of personal data concerned;
• the recipients to whom the personal data has been, is being, or will be disclosed;
• the envisaged period for which the data will be stored;
• the existence of the right to rectification, erasure, restriction of processing, and the right to lodge a complaint with a supervisory authority;
• the source of the personal data, if not collected directly from the customer;
• whether automated decision-making takes place.

The Lessor provides the first copy of the processed personal data free of charge; further copies may be subject to a reasonable fee.

5.4. Right to rectification

The customer has the right to have inaccurate personal data corrected and incomplete personal data completed.

5.5. Right to erasure

The customer has the right to request erasure of personal data where:

• the personal data is no longer necessary for the purposes for which it was collected;
• the customer withdraws consent and there is no other legal ground for processing;
• the personal data has been processed unlawfully;
• the personal data must be erased to comply with a legal obligation;
• the personal data was collected in connection with the offer of information society services to a child.

5.6. Right to restriction of processing

The customer has the right to request restriction of processing where:

• the accuracy of the personal data is contested, for the period needed to verify it;
• the processing is unlawful and the customer opposes erasure, requesting restriction of use instead;
• the Lessor no longer needs the data, but the customer requires it to establish, exercise or defend legal claims.

5.7. Right to data portability

The customer has the right to receive the personal data concerning them in a commonly used, machine-readable format, and the right to have it transmitted to another controller.

5.8. Right to lodge a complaint with a supervisory authority

If the customer believes their personal data is not being processed in accordance with applicable law, they have the right to lodge a complaint with the Czech Office for Personal Data Protection (www.uoou.cz).

6. Automated decision-making

6.1. No automated decision-making or profiling takes place when processing personal data.

7. Cookies and external services

7.1. The Website itself does not use its own analytics or advertising cookies.

7.2. For displaying fonts the Website uses the Google Fonts service, and for the booking system (availability calendar, sending requests) it uses Google Apps Script / Google Calendar, operated by Google. If a request cannot be sent via the booking system, the FormSubmit service is used as a fallback. These external services may process technical data (e.g. the IP address) when the page loads, in accordance with the respective providers' own privacy policies.
